Terms of service
The terms on which we provide freight forwarding, customs and warehousing services, and on which this website may be used.
Last updated 13 October 2026
Acceptance
These terms govern your use of this website and, where stated, the provision of logistics services by Cargoking Shipping & Logistics Pvt Ltd ("Cargoking", "we", "us"). By using this website you accept these terms. If you do not accept them, please do not use the site.
Where we agree to handle a shipment, these terms apply alongside the quotation, booking confirmation and transport document issued for that movement. If there is a conflict, the documents issued for the specific shipment take precedence.
Scope of services
Cargoking acts as a freight forwarder and, where applicable, as a licensed Multimodal Transport Operator. Depending on what is agreed for a given shipment, we may act as agent in arranging carriage with third-party carriers, or as a contracting party issuing our own transport document.
Our services may include freight forwarding by air, sea, road and rail, customs clearance, DGFT documentation, warehousing, third-party logistics, export packing, hazardous cargo handling and temperature-controlled movement, as described elsewhere on this site.
Quotations, rates and charges
Quotations are based on the information supplied by you at the time of the enquiry and are valid only for the period stated in the quotation.
- Rates may be revised where the actual weight, volume, dimensions, packaging, commodity or route differs from what was declared.
- Freight rates are subject to carrier tariffs, fuel and currency adjustment factors, congestion and peak season surcharges, and other carrier-imposed charges, which may change between quotation and shipment.
- Charges arising from circumstances outside our control are payable by you unless they result from our own failure. These include demurrage, detention, storage, customs examination, re-handling, re-routing and regulatory penalties.
- Duties, taxes and statutory levies are your responsibility unless expressly agreed otherwise in writing.
Your obligations
Accurate information is what keeps cargo moving. By instructing us you confirm that:
- You are the owner of the goods or an authorised agent of the owner, and are entitled to give instructions in respect of them.
- All descriptions, values, weights, dimensions, classifications and documents supplied to us are complete, accurate and lawful.
- The goods are properly packed, marked and labelled for the mode of transport and the route agreed.
- You hold any licences, permits, registrations or regulatory approvals required for the import, export or movement of the goods.
- You will indemnify Cargoking against any claim, penalty, duty, fine or cost arising from inaccurate information, incorrect declarations or missing authorisations supplied by you.
Dangerous and restricted goods
Dangerous, hazardous, restricted or regulated goods must be declared to us in writing before booking, with the UN number, proper shipping name, class, packing group and safety data sheet.
We will not accept undeclared dangerous goods. Where undeclared or misdeclared hazardous cargo is tendered, we may refuse, unload, return or dispose of the consignment at your cost, and you remain liable for any resulting claim, penalty or damage.
Certain goods cannot be carried, including items prohibited under Indian law or the law of the destination country, and goods a carrier refuses to accept.
Liability
Our liability in respect of the carriage and handling of goods is limited in accordance with the applicable law and international conventions, which may include the Multimodal Transportation of Goods Act, 1993, the Carriage by Air Act, the Hague and Hague-Visby Rules as applied to carriage by sea, and the Carriage by Road Act, together with the terms of the transport document issued for the shipment.
Where applicable, our services are additionally subject to the standard trading conditions applying to freight forwarders and customs brokers in India.
Subject to applicable law, we are not liable for indirect or consequential loss, including loss of profit, loss of market, loss of contract or loss of use, however arising.
Claims must be notified to us in writing promptly and in any event within the time limits set by the applicable convention, carrier terms or transport document.
Insurance
Carrier and forwarder liability is limited by law and by contract, and is not equivalent to insuring the value of your goods. Cargo insurance is arranged only where you expressly request it in writing and it is confirmed by us before the shipment moves.
Where no cover is requested and confirmed, the goods travel uninsured as regards their value, and any loss or damage is subject only to the limited liability described above.
Payment
Invoices are payable within the agreed credit terms, or on presentation where no credit terms have been agreed in writing.
- Payment must be made without deduction, set-off or counterclaim.
- We may exercise a lien over goods and documents in our possession for sums due to us, to the extent permitted by law.
- Overdue amounts may attract interest and recovery costs.
- Release of cargo or documents may be withheld where payment due on that shipment has not been received.
Delays and events outside our control
Transit times quoted by carriers are estimates, not guarantees, and we do not warrant arrival on a specific date unless expressly agreed in writing.
We are not liable for delay or non-performance caused by events outside our reasonable control, including port or airport congestion, carrier schedule changes, customs or regulatory action, strikes, weather, natural events, war, civil unrest, epidemic, or failure of infrastructure or utilities.
